it won't be that simple. The contract is binding and enforceable. If it has to become a matter of involving your state's attorney general for breach of contract, so be it.

The dealer does NOT have the final say contrary to what they claim today. Everyone is subject to the same set of rules and laws.

Yes they asking way too much for the car, it will never sell at that price. Thats why i offered them 12,500 as it does have an accident. The car is clean for the most part, it does have minimal damage on the radio controls.

If the car is in their possession, I would be hesitant to take it now...

yes - give them grief -
Contact THEIR local paper's 'investigative reporter' and see if they will publish the story...

but I wonder what might 'happen' to the car if you DO force them to give it to you ?!?

If they are bad at one thing.... they are probably bad at all things... and a used car is a gamble if all is on the up and up

You did not win an auction; you made an offer of $12,400. We countered with, what intended, of $19500. We did make a mistake, and countered with $12,500. You were contact immediately after it was sent by both email and phone informing you of the error and the correct counter. This was not a live auction, it was a car listed in our eBay store. There is a difference. Ebay in their user agreement, something you had to agree to in order to make a offer, states these are not binding. We did not wait, we did not make you make the trip to our dealership and try and bump you when you got here. We did the honorable thing and contacted you immediately. I'm sorry that an an error was made, but we are human!

That is simply no true. No lawyer has called here, and we would not speak to him that way even if he did. You have him call me and I will be more than happy to discuss this with him

Our side of the story is we made an error in typing our counter offer and contacted the OP with in minutes of making it, both by phone and email. Based on NADA, the car is fairly priced. In order for the OP to make the offer, he had to agree to eBays terms and condtions. In the terms and condtions it states that this is a non binding offer on both ends. We did the correct thing by contacting the OP with minutes of the mistake.
