Default Seeking advice on VA traffic court.

Pegged: S4 85 in a 55 on SB 395.


Hola!

I've actually had a license for 16 years and never landed in traffic court. I suppose that fact alone will be my best defence, but in an effort to go in with a little more backing: Anybody have some tips on dealing with these folks? Is there any chance this can stay off my record?

My one and only other speeding ticket was also in VA (75 in a 55), but it was a county officer that got me. Wrote out a ticket with "Commonweath of Virginia" scratched out and the county penciled in. Will the judge in the state court have access to this ticket, and subsequently, know what a menace to society I am?

And by the way, if I had taken the day off work, I could have been making friends AND speeding like a freak without tickets. It was the same day you were all heading down to VIR for a track day.

Default did they write you a reckless driving ticket?

they should have if it's 85 in a 55. My advice, get a lawyer. Eugene will disagree with me, but I can't sweet talk judges like he can. FYI: Reckless in VA = a misdemeanor AKA a criminal record. Enjoy!

Default Just go to the court about 30 or 45 min early and go see the prosecutor

he'll be in a room right by the courtroom - tell him you want to make a deal - he'll offer a fine and no points most likely -

Fairfax or Alexandria?

Default Get a lawyer who is familiar with the prosecutor

I think you have a serious possibility of losing your license for at least 30 days and maybe longer.

What is having a drivers license worth to you?

Default prosecutor will want to talk to the officer first

He'll make sure you acted respectfully. If the cop thinks you had attitude, it will work against you in the deal-making process.

At 30 MPH over the speed limit, this is a serious offense in the eyes of the law in VA. If you had been doing 90 MPH, you probably would have had some jail time. That's how close you are to what they consider a really big problem.

I agree with the others who have said to get a lawyer that works in the district where the court is. I've done this twice and it didn't save me much money but with reduced sentences, points, and fines, it was still the best solution.

So did they write you up for reckless driving?

How did they determine your speed? Radar on the side of the road? Pacing?

...respond. The court is Fairfax. It is a reckless driving ticket, but it is actually 82 in a 55, not 85, which my research tells me makes all the difference in the world.
