Default Anyone ever been in accident with a cop, when the cop is at fault?

Neighbor just came home from his folks in Longmont, Thornton cop rear ended him on 120th. Cop was looking at his computer dispatch, watch traffic with his peripheral, traffic braked, cop braked late. Rearended Honda Accord at 15 mph. Bumper, tailights, hood all dented up.

So the cop said he was distracted? That's an admission of guilt in itself. The cop is totally at fault. No matter what, he needs to pay attention to the traffic in front of him and control his car. No matter what.

I almost T-boned an Arapahoe county Sheriff about a month ago. Here's the great part, I totally laid on my horn AND flipped her off! She couldn't do anything. It was her fault all the way. I had the right of way and she completely pulled out in front of me. She let the first two trucks go by and then somehow lost sight of me and pulled out. I missed her by about 10 feet after nailing the brakes on the '98 Chevy Silverado I was driving. If I had hit her in the door, it wouldn't have gone well for her at all.

I was so pissed because all of my sound recording gear was in the back of the extended cab area. It all flopped forward and some onto the floor. Nothing got broken, but still, $30K worth of TV gear flying around is no fun.

Default i was under the impression that the person who does the rear ending is responsible..

i know depending on the circumstances, but this seems pretty cut and dry..

if the cop was a civilian, you bet your *** he'd be ticketed and have a mandatory court appearence..

Default Did they demand another squad be dispatched? Or did the officer write his own ticket?

Better yet, I think I would ask for a supervisor in that situation.

Default No, but I know the procedure.

I cannot speak specifically for Thornton PD, but I know how things work in Boulder:

1. The involved officer notifies dispatch that he was involved in a motor vehicle accident.

2. Dispatch sends two responding units: one on-duty supervisor and one officer.

3. The supervisor responds personally to the scene as a witness and the second officer responds to take the accident report. Involved officers ARE NOT permitted to write-up their own accident reports or issue tickets.

4. At the supervision of the responding supervisor, the involved officer must complete a personal memo addressed to the supervisor recounting his involvement in the accident. This memo gets passed along with the accident report to Internal Affairs.

5. A review of the incident is completed and a determination is made regarding fault.

That's pretty much it in a nutshell and happens a lot faster then you would think. A department takes officer involved accidents quite seriously.

As for fault, without knowing ALL THE FACTS, I can only speculate that the officer was guilty of a traffic infraction known as 42-4-1008: Following too closely. It is a Class A traffic infraction and specifically reads, "The driver of a motor vehicle shall not follow another vehicle more closely than is reasonable and prudent, having due regard for the speed of such vehicles and the traffic upon and the condition of the highway."

Thornton probably has their own Municipal Law equivalent, but I don't know what that is (either, not both, could be written).
