Default Definetly Fighting this Ticket...

Well, since there has been the speculation and comments about the left lane law, just thought I would chime in from a persoanl angle. Myself and a coworker both got ticketed by CSP this afternoon for this. Coming back to Denver from picking up loads in Nebraska.

We were in the left lane on I-76 passing some slower trucks on the slight grade between Sterling and Brush. Both of our trucks were heavily loaded 80,130 & 79,990 respectively, we were passing some slow moving oversize load trucks, but lost power trying to get up the slight hill. Our speed dropped from 75 mph to 70 mph by the time we crested the hill (about 1 mile in length). There were three cars behind us, CSP in an unmarked was the third car. As soon as possible we got over in the right lane, but the a**hole came around pulled in front of me, tapped his brakes and pointed towards the shoulder.

$200.00 + 3 pts We both intend to fight this one. The cop new darn well why we lost speed, his comment, we never should have passed the other trucks. BS and he knows it, when we jumped out to pass, the nearest car behind us was several miles back. The two oversized loads we were passing even slowed down to let us over once they realized we were losing speed. So we actually got over before the top of the hill.

This cop was a total jerk, but I got him on one item, I carry a micro recorder in the semi with me. Whenever I deal with the cops it sits on the dash in plain sight recording. I asked him if he thought that it was a tad ridiculous to stop us considering we never really held up traffic, considering that the average speed on I-76 (according to CSP reports) in that area 83 mph, maybe he should be worrying about speeders. On tape his exact words "speeding is not as dangerous as stupid truckers being in the left lane". Really, I don't recall there being a law against me being in the left lane when I'm passing slower moving traffic. Something tells me his watch commander will want to hear that tape.

Default is it the jef co sheriffs or golden police that have the speedtrap in north golden on 93?

I drive that section a lot, and 9/10 times I see the same speed trap in the same damn spot.

Default Be careful

It was widely reported last weekend or late last week that the CSP was going to be on the look out for left lane violaters. Per the article, which I will try and find (found it), they stated that it is okay to speed (within reason) to pass. And unless it is too dangerous for you to get over, you should NOT be in the left lane unless you are engaged in passing.

He probably went a little overboard since you lost speed. However it could be argued that you knew you would lose speed and there fore were never really engaged int eh passing.

I really hope you can beat it, but the law does not mean you are holding up traffic, it means you are in the left lane and NOT passing.

Here is an excerpt from the article:

"The law says that a motorist will not drive in the passing lane of any highway if the speed limit is sixty-five miles per hour or more, UNLESS passing other vehicles in the non-passing lane, turning left, or unless the volume of traffic does not permit the motor vehicle to safely merge into the non-passing lane.

In other words, the passing lane (the far left lane, or fast lane) is for passing only if you are on a highway where the speed limit is 65 miles per hour or more. The passing lane is not to drive in if you are not passing cars.

The State Patrol in Colorado will now pull you over and ticket you if you stay in that passing lane when you are not passing cars.

Interestingly, if you are in that passing lane, and you are passing a car, you can likely go beyond the speed limit IN ORDER TO PASS the car, so long as you merge back into the non-passing lane when you are finished passing the car. The law and the State Patrol do not want you in the passing lane for mile after mile if you are not passing cars.

The State Patrol has in the month of January already issued over 150 citations for violating this new law, and it is a 3 point violation.

The lesson of this law is clear - slow drivers should not be in the fast lane; only cars passing cars should be there. Don't hog up or "park" in that fast lane."
