It absolutely turns on, as soon as you hit the brakes...
It can't perform miracles... If you've already lost it before you hit the brakes, it won't save you. If you are off the brakes, though, it stays off.

it may activate while the brake is depressed, but i have never had to manually turn it off again
after using breaks and i turn it off quite often in the winter to have some fun. the only time i have to reset it to off is if i turn the car off then it defaults to on when you re-start the car.
maybe mine is broken, but it works great when i leave it on. it has saved my *** many times, but i have been the ditch more than once with it off.
