Yes, we'll take your $5k and then decide when we get your car how much we'll charge for it. They call it MVA or market value adjustment. Nobody at Nissan seems to care and why should they? Unless you asked for the car at MSRP and they agree, you are subject to a market adjustment. Same goes for Corvette, Ferrari etc. Not a new issue. It is manufacturers SUGGESTED retail price after all. Some dealers have been clever how they approach this (Ferrari).
