Got a FLAT tire due from a street construction. Are they liable?
It's a few blocks from where I live. It's one of those large steel metal sheet on top of the road - probably to cover the fresh cement underneath. My tire approached the edge and it slashed the inside wall. When I got home I can hear and smell the air leaking and I was watching the tire as it was deflating.
My question: 1. Can I have the city liable for this? Of course it may be a waste of time and too much hassle. But I would appreciate advise on how to proceed with this. 2. I'm now at 18,000 miles with the OEM tires on the Ultra Sport package - Continental Conti SportContact2 235/40 R18. I've seen reviews where they replaced the tires immediately from fast wear (due to being high performance summer tires, of course) but my tires don't show that it's ready to be replaced via TWI and the penny test. How long do you guys think this tire can still hold up? I'm going to replace the spare tire with Michelin Pilot Sport A/S. Then I plan to replace the rest of the four tires the moment I wear out the Contis. |
I remember reading on here someone got the city to pay one time...
They hit a pothole and of course it's the city's responsibility to take care of them. I don't know who it was or where it was, but I remember reading it. I think they gave him a new rim and tire.

yes ....if you can prove that it caused the damage they are liable.

Ha ha. Of course, here's the difficulty. Investigating will be more...
expensive than buying a new tire. Oh well. Will take pictures just in case.

What do you mean 6 months to sort out? They reviewed the conditions or they disputed the case first?

just go take pictures now. get it fixed then send the bill to the city
with a polite, but serious letter. it really cant hurt to try, you'll be only out your time and postage.

I'm filling it out right now and will take pictures first thing tomorrow morning of the road construction and my tire damage.
You're right it doesn't hurt to try except time and postage. Will update the result - maybe months from now. Hmm. Less than a year, maybe. Hopefully. |
