View Full Version : A dealer is not giving me my deposit back, what can I do?

Before I bought my S5 I put a deposit on another one at a different dealership (car was arriving later) just in case the first dealership wouldn't give me a fair trade in value. The first dealership ended up matching the others so I ended up getting the car there. This was on NYE. I contacted the other dealership asking for my refund back and the salesperson agreed. A couple weeks later I still didn't see the refund so I called him again and he said that he processed the refund (which is bull**** because it only takes a few days). I asked to speak to the sales manager and left a voice message and he didn't even get back to me. What can I do at this point?

Assuming the in person visit suggested doesn't work -

First, dig out whatever they signed and/or they gave you with regard to your order and deposit. Make sure it's refundable (which it should be). Send a letter to the manager you spoke to with a copy to the salesman, setting forth the relevant amounts and dates and citing anything in the agreement that makes it clear your deposit is refundable. Breifly recite your communications with everyone there, including dates and the indications that your refund was being processed. Say that you are making one last request to resolve this prior to pursuing a small claims action (which in most states can be filed without need to retain counsel) to recover your deposit. You can also threaten the usual BBB report etc. Establish a date by which you need confirmation that the deposit has been processed. All of this will make it clear that you have your ducks in a row and are ready to give them more trouble than their deposit is worth. Good luck!

It matters. For example, in CA there is a statute on point because of this kind of crap.

there's still no credit shown by Friday, tell them you're disputing the charge with your CC company & reporting them to the BBB.

I called them back and asked for the refund again. I told them I will contact audiusa and BBB and this guy gave me my refund right away. thanks for the help everyone.
