I hope there is a way to keep the spoiler permanently in the up possition. I hate the rear end when the spoiler is down, looks like someone kicked the car in the ass and it is tucking in it's tail like a dog.

The very first production MK1 TT did not have a spoiler.
When a spoiler was added after some high speed accidents, many people (particularly designers Freeman Thomas and J. Mays) hated the intrusive add-on. But it was a necessary design downgrade to help keep the back end down.
Eventually many TT drivers got used to and even preferred the spoiler look.
With the new TT, the designers had the opportunity to properly design a spoiler that did not 'spoil' the true TT silhouette, therby the popup mechanism.
I personally prefer the TT without a spoiler, both for the MK1 and MK2. It's a more pure design statement.

In fact the rear end reminds of the Hyundai Tiburon.
Don't get my wrong. The Tiburon is nice looking little car, but should Audi engineering have used that as their inspiration?
The hand drawings that came out just before the unveiling showed a very Porsche-esque (long, sloping) rear end. What I see now just doesn't quite look nearly as nice as I thought it would.
