As some of you may know, I was involved in a drunk driving hit and run accident about a month ago...i ended up continuing with my insurance claim and they have since totaled my car...I have been trying to get the name of the insurance company of the guy who hit me (he was in a company truck...need insurance company for his company), but I cannot find it. I have spoken to the president of the company and he refuses to give me the name of the insurance company until i show him an estimate for my vehicle...well that doesn't matter because the car has already been totaled. He tells me "go through insurance if you want to but I'm not going to give you the name of my insurance company". All I want is the name of the company so I can get compensation for a rental vehicle while i am looking for a new car. My insurance company does not have the other insurance company name because they have not received the State Police report yet (takes 90 days to get to them) and i have been unsuccessful in trying to get a report directly. I'm not sure if a lawyer is the way to go at this point, but i at least wanted to talk to one. Sorry if this makes little sense as I am extremely heated right now after getting off the phone with this company president and him saying that he does not believe his employee was drunk (even though the DA charged him with drunk driving and leaving the scene of an accident). Any recommendations for a lawyer that I could at least TALK to would be great.

let me know if I'm wrong here, but I can't buy a new car until I get the money from my insurance company to do so...they will not give me money until I give them my car...I cannot give them my car until I have a rental car to use in the mean time while looking for a new car...I cannot get a rental car until I get the name of this insurance company in order for them to compensate me for the costs of the rental car (which i cannot pay for at this time)...and i can't get the insurance company name until my insurance company gets the police report...should I just continue to drive my car as is for the next 3 months until i get the name of the insurance company from the police report and then my insurance company will take care of the rest? For some reason, my insurance company cannot get the name of this other insurance company...is that unreasonable?

It also sounds like this isn't the first time this has happened, and also that the two are friends.
I wonder if the company's insurance covers personal use?
Anyway, the other guy's insurance company is likely going to cover a very minimal rental for a very minimal (and completely unreasonable) amount of time. Peerless, the company who insured the van that hit me, said they only offer <b>3</b> days of rental coverage, but that they would extend that to 5 (still completely unreasonable) because I complained so loudly. You will probably have to take the driver to small claims court in order to get reimbursed for the rental.

In the end as part of a settlement or judgment? Sure. Up front? Your cashflow is not their problem. Can you put the rental on a credit card for the time being? Since you have no backup, consider paying the modest extra premium for substitute transportation coverage on the new car. Anyway, if you ask the investigating officer nicely, he/she probably will just tell you the insurer's name. If you ask extra nicely, he/she might even fax you a copy of page 1 of the accident report. They don't really care about page 1. It is the rest of the report they want you to jump through hoops to get.

when the accident happened, the cop told me to go home once he found I was ok, and that they'd take care of the rest....now considering this was the first time anything like this has happened to me, i took his word...I wish i didn't and I wish i had at least got the cop's name, the guys insurance company, the license plate number, anything that would help me now....but i never really thought about it, i just wasn't in the right state of mind...i'm doing my best to document everything from here forward...it just doesn't help when this guys is such a d!ck

and at this point it looks like if i don't get the insurance company off of the BPD police report tonite, then I will be driving my car, as is, for the next 3 months until the state police report comes in...

unless when I show up at the BPD tonite, they give me the report...but even they said that because the guy was arrested, they can't give me information on his insurance company for some reason...so i'm hoping if i get the BPD police report for my insurance company, they will take care of the rest...at this point, I will be driving my car until the state police report comes in with the insurance company...i can probably afford the rental car, but refuse to at this point, after this guy was such a d!ck to me!

days to a week. They should be asking you what you need to get by not you asking them. It is true that your not going to get any money for a new car if they total it and you haven't released it. If it's was already totaled then I assume some time has passed, the police report should be available by now. Call the police and talk to the officer who was in charge of writing the report.

Go to the RMV. Truck reg is public info.

You'd have to track down the specific franchise this truck belonged to first. I don't know if they have many franchises in the area, or if there's only one.

Factor that into things relative to your rental car costs. You will get everything that you are owed, but it will take some time. That's just the nature of the game.
