Background...friend bought a Toyota Camry and paid for it in pull, because they promised delivery by a particular date. Now, they can't find the title. He asked if he could get a loaner until they get a new title and they told him to F himself. His choices were keep waiting or they'll give him all the $$ back. He doesn't object to leaving a deposit and paying in full after they get a duplicate title.
I'm hoping to find someone to speak with someone with power to see if holding a customer's $$ is standard operating procedure.

waiting for a title is a PIA but it doesn't change the deal he got. Tell him to bring the car back, get his money back and tell them to call him when the title gets there and he'll do the deal. If he holds onto the car while they're waiting for a title they'd be crazy to give him his money back, right?

they gave him a loaner for a few days and wanted it back. Chambers still has the car he wants to buy.

he's already paid them for his new car, right? if so then I stand by what I said. If not, give the loaner back and take his business elsewhere.

I'm no lawyer but it seems that there may be some section 93A issues here. If they can't produce a title, or loan him a car until they do, they should produce a refund. If he goes for a refund, I'll bet they try to charge him a mileage depreciation. Does he have an attorney? He may need one who specializes in consumer protection.

They gave him a Corolla to drive around while they searched for the title. The general manager seemed to think he'd have no problem selling the car if my friend cancels the deal. I never thought of them trying to ping him for miles on the loaner.

I had one of my finest curse sessions in the center of their Toyota dealership in Auburn years back. I warn anyone possible to stay away.

they are too damn cocky for their own. I'll drive to another dealership instead of dealing with them.
I have to admit they helped me with an out of warranty before, but I know they've screwed me for other stuff. Wash.

They have his money! He paid full price for a car that they can't deliver to him. They should at least provide comparable transportation (not a T pass) until they can deliver the car.
I would take my money and walk and spread as much negative word of mouth as I possibly can about them!
