View Full Version : Speeding ticket in Costa Mesa.. advice?
Chicago-2001 09-24-2006, 02:02 AM This weekend didn't start on a great note. My first speeding ticket in 5 years. On the bright side, I was going 89 (apparently) on the 405 but the officer wrote me up for 75. She said it should allow me to pay a smaller fine and go to traffic school.
Questions: how much is the fine for doing 75 in a 65? Should I show up in traffic court? I've heard/read that in CA, there's a good chance the officer won't show up and the case will get dismissed.

just pay the fine and take traffic school. with this being your first ticket in 5 years i dont think its worth fighting. plus, if you fight it you loose the option of traffic school.

If they do not send you the notes within a "reasonable time" (usually 30 days) then you can move to have the case dismissed because the state would not provide evidence in a timely fassion in order for you to prepare your case.
That's probably your best option.
DeutschDriver 09-25-2006, 09:41 AM trial by written declaration and other such paper-shuffling techniques can work pretty well, and if you fail you can usually still attend traffic school.

Chicago-2001 09-25-2006, 11:29 AM What is a resonable time? The court appearance date is Nov 30th so that really is a chunk of time, 2 months nearly.
Basically if I send it out this week but don't get anything back by Nov 1st I can write in for a dismissal? Or do I have to show up and ask for a dismissal?
Does this still take away the option of traffic school?

PenQuin 09-25-2006, 02:03 PM out. Ask for the officer's notes and a copy of the ticket. Don't know what a reasonable amount of time is, but I have a feeling it is around 30 days from inquiry.

I meant if asking for a copy of the officer's notes and a copy of the ticket takes away any chance of traffic school.
Can you do traffic school in OC? I've heard you have to go to the class as OC courts don't allow online schools.

PenQuin 09-25-2006, 03:12 PM you can at least see what the officer would be saying if you did go to court (are there any inconsistencies etc.) Not saying it's the silver bullett, but it might do the trick!
Chicago-2001 09-25-2006, 06:27 PM If I have to show up in court, can I see if the cop shows up before I make a plea? I've read that judges will ask for a plea before asking the officer to step forward or enter the court room.

Chicago-2001 09-28-2006, 07:55 PM My V1 didn't even go off, I think she may have paced me trying to catch up to me. I was heading on 405N and we stopped around Harbor Blvd. This was the first time I've seen a CHP hide there and I was in a rush and in a bad mood so didn't even see her. I'm normally good at spotting them.. but anyways..
I've seen the ticketassassin website. My idea was to try to do a few paperwork defences and if that doesn't work out, then give up and just do the traffic school.
