The 1 month new fresh paint is now scratched and chipped at the fender, light housing, and hood. The light is bind up against the hood and won't extend and retract anymore... Welcome to California to me! ;o(

Thanks to <a href="http://www.dasautoshippers.com/">these people</a>.

Rest of damage pics <a href="http://flickr.com/photos/10130529@N05/sets/72157605909580556/">here</a>. I'll be taking more of it during daylight.

Wonder what my Audi would have looked like had I shipped it. I can't wait to see what kind of damage my Tacoma will arrive looking like. :o\

Did they tell you what happened?

<i>"8. Carrier shall in no event be liable for acts of God, acts of Public Authority, acts of public enemy, acts of Shipper or inherent vice. Shipper agrees that the liability of Carrier for loss of damage to the Vehicle is limited to a maximum of $150 per shipment (See 49 U.S.C. 14706) unless Shipper requires Carrier to assume greater liability by declaring a higher value ("Actual Cash Value"), in writing, on this document, prior to shipment (see Form A, below) and paying additional freight charges for valuation coverage commensurate with the higher declaration of the Actual Cash Value in advance of shipment. Failure to declare a higher Actual Cash Value and to pay the additional charges associated therewith, in advance, will serve to limit Carrier's liability for any damage or loss to the Vehicle to $150."</i>

I didn't know about, nor buy additional coverage... :o\

So basically I read that as: the most I can get from them is $150.... right?

For my own car insurance, the Miata has liability, no collision, and $250 deductible on comprehensive.

They delivered to me on a flat bed (not off the 18 wheeler auto carrier) tonight at 8:30pm or so... right when it got dark. I saw the damage while the car was still on the truck, went back to my hotel room to get my camera. By the time I got back, they got the car off the flat bed already. Don't think it matters anymore, but would have made a stronger case had I got pics of damaged car while still on their truck.

See for example the case at the URL below. The company is to do certain things to take advantage of the Insterstate Commerce Clause (or whatever 49 USC 14706 is).<ul><li><a href="http://www.5dca.org/Opinions/Opin2003/012003/5D02-1168.op.pdf">Possible Exception</a></li></ul>

I would be balistic right now. I would probably have taken a lug wrench to the delivery guys fender and asked him how that felt to just have someone bust up your car....

Do a posting there. You'll get a lot of advice, some useless but somebody may have gone through the same thing, possibly with DAS.

The other way Consumerist can help is with shame/public exposure. Consumer goodwill has a tangible value and "customer acquisition cost" is a calculated figure at many businesses.

If DAS thinks the cost of repair is cheaper than the loss of future business, they may pay you regardless.

Plus send them the URL to this thread - which includes my statement "I will never use DAS" - a loss of goodwill right there.

at the 'Service Recovery Dept' and they emailed me a claim pkg.

I'm to submit:
- completed claim form
- ONE written estimate
- photos of claimed damage
- copy of my Bill of Lading at delivery

Then I'll be assigned a claim adjuster, whom will make the determination of the corrective action DAS will take.... :-\

Thus I'll need recommendation on repair shop(s). Keep in mind this is(was) my track car, even tho I JUST had it painted 1.5 months ago. (Macco paint shop in VA whos owner is an auto-x'er and gives 'racers' special treatments)

<a href="http://consumerist.com/">Consumerist.com</a>?

That site looks to be more of an e-magazine, then a forum. I don't see where I could 'post' anything other than be a 'commenter' and leave comments on their existing articles. Even then, I have to 'audition' to be a 'commenter'...

I was led astray by this... http://consumerist.com/tag/bad-install/?i=5020723&amp;t=car-stereo-company-tries-to-install-gps-causes-1239854-damage-to-your-car

Looking closer, you have to submit your info to them and they decide what to post.

I should have RTFM, before giving advice...
