View Full Version : My car stolen from an Audi dealer!! Need help and advise

Hello!
Please read even it's too long and please help me or give me some advise.
I left my 97 A4 2.8 at Miramar Audi in San Diego for maintenance on Monday(9-24). Today, 9-26, some unknown person called my home and told me that he found my car on a street and he's keeping it safe for me until I pick it up. So, I called the dealer(Miramar Audi) and ask them if they were aware of it. They said they will check and call me back. 3 minutes later, the advisor called me back saying that they lost my car. They didn't even know my car was stolen until I told them. The service manager told me to go to Police Dep. and file a report. So, I went to Police Dep. and gave out all information about the guy who called me and how the car was stolen. One of the officer told me that actually I'm not the one suppose to report the lost since it was stolen from the dealer, and they are suppose to report the lost and be resposible for.
Finally I did get my car back and the thief was the person who called me. The car was stolen directly from the dealer and the car door was open with key in the car. The thief drove my car for almost 300 miles but nothing was missing or damaged except minor scratches and some coins. Detective told me that I need to report this to Business Bureau, Auto Repair Bureau and get an attorny to sue the dealer so they can do something for me even the work order(the dealer's policy) says they are not resposible for lost or stolen. When I talked to service manager of Miramar Audi on the phone, he told me that they are not responsible for the stolen because it's just exactly as same as getting a car stolen from a Vons Market. I was so mad but I didn't know what to do or to say. I went over to the dealer with my found car to talk in person. When the manager saw me, he told me that he will pay for the cost of maintenance which cost $115. So, I just left my car there again and went back home.
Do you think I shall ask for more? Do you think I still need to report this to Bureau? But if I report it to Bureau, what can they do?
I really need some advise on this I'll really appreciate any advise.

The first legal question is "What is the measure of your damages". In other words, how much were you harmed? You have the car back, so you did not lose the value. There is minor damage, so there is no great financial loss except to repair the scratches. There is some loss of value because of the additional mileage, but I wouldn't want to have to compute the dimunition. I would count myself lucky if I were you.

I would assume the dealer has some security guard on duty (at least the dealer here does.) From that and the fact you handed your keys over to them, I would think they have some responsibility of your car being stolen. They should cover the damage, I would think.

Tell him that unless he wants you to call the local ratings-hungry TV news expose artist, he must give you the keys to an S8 for the exact amount of time your car was gone.

Tom is correct. You as well as the dealer are quite lucky. I make damn sure whenever I take my cars in anywhere that I lock them as I leave and tell them to lock them after they finish their work on it. If I go back and I find the doors unlocked I will go up to the desk and ask the fricken moron at the conter if they leave their cash register wide open! That always gets them. My car is values waaaay more than their cash in the till at any point so I assume they should take more prudrnt care of my car right? Anyway, I would go get your jock strap on and call up that service manager and demand an explanation. Be firm. I will be glad to call them up and act as your attorney. That always scares them! Let him know this is Bullsh*t and you are going to use another Audi dealer who is more concerned about their customers and their vehicals. Let him know you have contacted the BBB and your attorney has been notified. Ask for some simple service like an oil change, radiator flush, balance & alignment, etc and you want a loaner car while it is being serviced. Come back and check on your car as they work on it. After they are finished, f*ck them and move to the Audi dealership on the other side of town. Yea that one would piss me off needless to say.
