Hello,<br>I bought a used car recently at Bramgate in Toronto. My only question to the sales person was if the car was ever in any accident/ repainted. I asked this question at least 5 times and the answer was a definitive NO, she also said that they would know for sure because the car was leased and would've had to be fixed at their dealership. So knowing the it's a respectable dealer I took her word and bought the car. 1 month later I noticed some spots under the paint, went to a body shop (independent) and Yes, the car was repainted (basically they lied!). I went back to Bramgate , and they found papers that it was in a minor accident and fender was fixed and repainted.<br> I would've never bought the car if I knew it was not original. <br>Bramgate says - "We appologize", which is in my opinion NOT ACCEPTABLE. should ether take the car back and refund your money, or you should take them to court. It may be "american" to sue, but you (small guy) never get the dealer (big guy) to listen to you ... until the law gets involved. It sux, but I'd tell them to refund the $$ or speak to your attorney.<p>jon<br>'96 A4qs

..go back and give them the "contact my attourney" thing, but i wouldn't push for a refund of your money. If the car is still a good one, i would go for free scheduled maintainance or settle on a partial discount. Maybe the cost of the original repairs plus some % since they did lie to you. I would then take that and go get a chip, suspension, etc. Basically I'm saying that if you really like the car and the fender repairs don't affect anything else in the characteristics of the car, i would keep it and try to get something that would really benefit you. Getting another car that hasn't had a painted fender won't make any difference really. (except in resale, but by then it won't make a noticeable difference in the value, especially since the work was done at the dealer). Just my suggestion. Good luck. And if they do give you a hard time, stick it to 'em with the "I'll call Johnny Cochran" thing!<p>JonathanD

I would request my money back.<br>If they don't, request a partial refund.<br>If they don't and you have the proof that you asked the question, pursue small claims court.

I like JonathanD's idea though...ask for some sort of restitution, but if the car drives well and is in proper working order (and of course to your satisfaction), I don't think getting rid of the car is necessary...<p>Let us know what happens......<br>-Ash 98.5 1.8TQMS

They don't want to give anything, I told them that they made a lot of profit on this car and my trade-in and I had nothing against this until I found out that they lied. Now, I believe they have no right to have that profit. There is no reaction, they can give me 200$ in free service but it's a matter of principal.<br>I know that a lot of people had a "great experience" with Bramgate (I couldn't complain before also) but in my opinion, the good dealership (or whatever else) is the one you can trust and not the one that has salespeople with phony smiles.<br>Anyways, thanks again,<p>Dima

While my experience with Bramgate was very brief, I had absolutely no problems when buying my car from Dean Turner at Bramgate. I knew the exact car I wanted and the price I was willing to pay for it. Within 10 minutes, I had bought the car, over the phone, and picked it up this weekend.<p>However, if they had the paperwork on the car and then tried to deny the fact the car was in an accident (intentionally or not), I am assuming that you have some legal recourse and action should be taken by you.<p>Regards,<br>Mike B.<br>silver 99.5 1.8TQMS

Any suggestions except the Small Claims? Takes money and time , that's my only concern.<br>But I agree 100% and I don't want to leave it like this. These guys agree with everything that I say and at the end they say "sorry, we can't loose money". ...<p>Dima.

I hate pushing buttons, but you would certainly be justified in this case. At the very least you should get a few additional years on your rust perforation warranty.<p>Bramgate may have a reputation as a "good dealership" - but this is when that reputation is put to the test. From a service perspective, whether or not a dealership had intentional knowledge of the previous accident - they should recognize that they have an unhappy customer on their hands (through no fault of the customer's) and do anything they can to rectify matters. Even to the point of losing the sale. Generosity on the part of a dealer at times like this pay them back in spades down the road.<p>(Am I too nieve (sp) ?)<p>Gordon

The damage is real minor.<p>I have told Dima this. The car was looked after in the best way possible. <p>Yes, the car was in a minor fender accident. Just a few light scratches. Heck thay even repainted the front bumper which had a few stone chips. Most body shops wouldn't do that. <p>Let me tell you, I would rather have an ex-leased car that had a minor accident and was looked after the way this one was, washed every weekend. Than to have one had neglected service, never vaccumed and had the guts run out of it!<p>You have a excellent car that will last you for a long time. nuf said.
