Is there and easy fix for the cup holder by the E-brake handle??
Mine in my car so how broke and will not hold it's self down longer. IS there a way to fix this and has it happened to others ?

Yes and yes
This is a common failure. The design of this cupholder relies on a teeny tiny piece of plastic which breaks off through normal usage.
There are two clips on the outside interior edge. If you slightly close the cupholder and look at the interior, you should see the clips on either side. If you press in both clips, the cupholder slides up and out.
Once out, remove the spring which holds the cupholder open. Reinsert the cupholder. You've now lost the spring loaded action, but you can still open and close the cupholder.
The other option is to buy a new cupholder and replace the existing one.
