When I hit a deer, it was considered an act of God. $100 comp even though ...
I was moving.
I'm not sure if they are going to deal with it the same way.
I don't lie and I'm not recommending it, but if you said you swerved for a deer, you might have a better chance. A deer could cause serious damage to the car and yourself and thus justifying missing the deer and hitting the gaurdrail. A racoon is a speed bump.

Sadly enough, I think this will be considered an accident with a guardrail because you didn't hit
the animal. This is why you should always hit the animal if there's ever a doubt in your mind, thus making it an Act of God. You swerving to miss an animal and hitting a guardrail is not treated as an Act of God. I wish you the best.

My insurance company is New Jersey Manufacturers Insurance. My claim rep even told me that my premium should not rise. Woohoo! On the downside, its gonna take a least a month to fix
