Some donkey hit me as I was pulling into a parking spot. He was going ~40 and I was going about 2-insurance company said its my fault....go figure.

Unfortunately I have back surgery at the end of the month to repair the herniated disk suffered in the accident. I can't stand up straight, lift anything up, and have trouble doing anything that requires me to walk/move. Putting on my left sock & shoe is the hardest part of my day. It's been a hassle and the insurance company stinks. Not going to name any names...but I don't like lizards anymore!
Also-the side airbag never went off-anyone have insight on this???

Sorry to hear that. Hope the surgery goes well. The experience I have had with orthopedic sorts of recoveries is be very patient. I have been cited 6 weeks, but my poor old body seems to take something more like 6 months for things to seem totally normal.
I have heard of side bags not going off on lots of different makes, but never found anything on exactly how they are designed. Be intersting to know if others have any insite.

Interesting that someone on the Benz forum I frequent had an almost identical accident and you will notice something obvious from the picture, that the side bags deployed...on both sides. It appears that the car that hit them was going faster, but still can't believe yours did not deploy at 40 mph...

It just registered with me what you said earlier. So the B pillar has to actually move to have the side bags go off? Explains a lot of questions I have seen regarding side impact bags. Do you know off the top of your head the reasoning for that? Crash tests show they don't help? Crash tests show the bag hurts the occupants? Show side head and neck injury or head bouncing off window not severe enough?
